Terms of Service
Introduction
Welcome to ScolerAI. These Terms of Service ("Terms") form a binding agreement between you and ScolerAI regarding your use of the ScolerAI mobile and web application and related services (the "Service").
ScolerAI is operated under the laws of the Republic of Turkey. By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
These Terms must be read together with the Privacy Policy and any in-app notices (e.g. consent gates, GDPR/KVKK disclosures), which together describe how we operate the Service and how your data is handled.
Eligibility
To use ScolerAI you must:
- Be at least the minimum age required to consent to digital services in your country (16 in Turkey and most of the EEA, lower elsewhere where local law allows).
- If you are under 16, have verifiable consent from a parent or legal guardian before enabling AI personalization or voice features.
- Provide accurate and up-to-date account information and keep it accurate over time.
- Not be a person previously suspended or removed from the Service for breach of these Terms.
If you are using ScolerAI on behalf of a school, parent, organization or institution, you confirm that you have the authority to accept these Terms on its behalf, and that the underlying users (including minors) will use the Service in accordance with them.
Acceptable Use
You agree to use ScolerAI only for lawful, personal educational purposes. You may NOT:
- Use the Service to generate, store or distribute content that is illegal, harmful, hateful, defamatory, sexually explicit, harassing, violent or otherwise inappropriate.
- Use the Service to cheat on exams or assignments where doing so violates your school's or institution's policies.
- Attempt to access, modify or interfere with other users' accounts, data or sessions.
- Probe, scan, reverse-engineer, decompile or attempt to extract the source code, AI prompts, models or proprietary algorithms of the Service.
- Use bots, scripts, scraping or any automated means to access, copy or overload the Service.
- Resell, sublicense, rent or commercially exploit the Service or its AI outputs without our prior written permission.
- Share your account credentials with others or allow another person to use your account.
- Bypass security features, rate limits, content filters or age-gating mechanisms.
- Use the Service in violation of Turkish law, the law of your country of residence, or any applicable export-control or sanctions regime.
We may, at our discretion, remove offending content, throttle abusive accounts, suspend or terminate access, and/or report serious abuse to the competent authorities.
Your Account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to:
- Keep your password confidential and not share it with anyone.
- Notify us immediately at info@scolerai.com if you suspect unauthorized access.
- Use accurate, current and complete information when registering and update it as needed.
You can delete your account and the personal data we hold about you at any time via Settings > Privacy & Data > Delete My Account. Once deletion is confirmed, your study content is removed from our active systems promptly and from backups within 30 days, except where retention is required by law.
We may decline to create, suspend or close accounts that we reasonably believe are fraudulent, abusive, or in breach of these Terms.
Content & Intellectual Property
ScolerAI, including its software, design, logos, AI prompts, model orchestration, study templates, and any related materials, is owned by us and protected by Turkish and international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own educational purposes.
Study content you create using ScolerAI (notes, flashcards, quizzes, courses, podcasts, sessions, plans, uploads) remains your intellectual property. By using the Service, you grant us a limited, worldwide, royalty-free license to host, store, display, transmit and process that content solely as needed to operate, secure and improve the Service for you.
You are solely responsible for the content you upload and create. You confirm that you have the right to upload it and that it does not infringe third-party rights. We may use anonymized, aggregated information about how the Service is used (with no personally identifying or content-level data) to improve features and reliability.
AI-generated content is provided as educational material and may contain errors, omissions or outdated information. You should always verify it independently before relying on it for academic, professional or legal decisions.
Service Availability & Changes
We do our best to keep ScolerAI available, but we provide it on a "best efforts" basis and cannot guarantee uninterrupted access. We may at any time, with or without notice:
- Perform maintenance, upgrades or security work that temporarily limits availability.
- Add, modify or remove features and AI providers.
- Apply usage limits, rate limits and fair-use policies to protect the Service.
- Suspend or discontinue parts of the Service if a third-party provider becomes unavailable.
Where a change materially reduces functionality you rely on, we will provide reasonable notice in the application before the change takes effect.
Suspension & Termination
These Terms remain in force for as long as you use the Service. You may stop using ScolerAI and delete your account at any time.
We may suspend or terminate your access, with or without notice, if:
- You materially breach these Terms or the Privacy Policy.
- Your use poses a security, legal, financial or reputational risk to us, other users or our providers.
- We are required to do so by applicable law, court order or instruction from a competent authority.
- You attempt to circumvent age-gating, parental-consent flows or content filters.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive — including Acceptable Use, Content & Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution — will continue to apply.
Disclaimer
The Service and all AI-generated content are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation, to the maximum extent permitted by Turkish law.
ScolerAI is an educational tool. It is NOT a substitute for:
- Qualified teachers, tutors or academic advisors.
- Medical, legal, financial or psychological advice.
- Official curricula, certifications or examinations.
You are responsible for verifying the accuracy of AI-generated content before relying on it. Nothing in the Service constitutes professional advice.
Limitation of Liability
To the fullest extent permitted by Turkish law:
- ScolerAI, its founders, employees and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost data, loss of opportunity or loss of academic outcomes, arising from or in connection with your use of the Service.
- Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the total fees you paid to ScolerAI in the 12 months preceding the event giving rise to the claim, or (b) the equivalent of fifty (50) euros.
- These limitations do not apply to liability that cannot be excluded or limited under Turkish law (e.g. liability for gross negligence, willful misconduct or non-waivable consumer rights).
Indemnification
To the extent permitted by Turkish law, you agree to defend, indemnify and hold harmless ScolerAI, its founders, employees and providers from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms or the Privacy Policy.
- Your misuse of the Service or content you create or upload.
- Your violation of any third-party right, including intellectual property, privacy or publicity rights.
- Your violation of any applicable law or regulation.
This obligation applies in addition to, and does not limit, any other rights or remedies we may have.
Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, technology, or applicable law. When we make changes that materially affect your rights or obligations, we will:
- Notify you in the application at least 14 days before the changes take effect.
- Where required by law, ask for your renewed consent before the changes take effect.
If you do not agree with the updated Terms, you may stop using the Service and delete your account before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms.
Governing Law & Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by, and shall be construed in accordance with, the laws of the Republic of Turkey, without regard to its conflict-of-laws rules.
The courts and enforcement offices of Istanbul (Çağlayan / Istanbul Mahkemeleri ve İcra Daireleri), Turkey shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Service. This does not affect any non-waivable rights you may have as a consumer to bring proceedings in the courts of your place of residence.
Dispute Resolution
Before initiating formal legal proceedings, we strongly encourage you to contact us at info@scolerai.com so we can try to resolve the issue amicably and quickly. Most disputes can be resolved this way within a reasonable time.
Consumers in Turkey may also apply, depending on the value of the dispute, to the competent District or Provincial Consumer Arbitration Committee ("Tüketici Hakem Heyeti") or to the Consumer Courts ("Tüketici Mahkemeleri"), as provided by the Turkish Consumer Protection Law No. 6502.
For data-protection-related complaints, you may contact the Turkish Personal Data Protection Authority (KVKK Board) at www.kvkk.gov.tr, or, if you are in the EEA, your local supervisory authority under the GDPR.
